MEMBERSHIP TERMS AND CONDITIONS

WHEREFORE, without limiting the Member's obligation to obey the rules and regulations of Discounts Card (herein referred to as “DC”) presently in force or in the future prescribed, Member agrees that he/she will keep and obey all the following rules and regulations:

1. The membership is on a yearly basis for a non-refundable subscription fee. The yearly subscription will commence on the date of payment of the subscription.
2. DC may change membership subscriptions under this Agreement by giving three (14) days written notice to the members of such change.
3. The member shall not use the facilities and discounts offered by DC if the member is not up to date with subscriptions.
4. The member cannot share the discount voucher with a third party. Only the member can benefit from the discount offered by DC. It is expressly understood and agreed that this contract is not assignable or transferrable by Member and no rights or privileges granted by this membership can be transferred or assigned by Member.
5. DC assumes no responsibility for any arrangements, contracts, purchases, or disputes between the member and the Vendor that may arise from the discount offered through DC.
6. The Member is responsible for handling all questions and disputes from resulting from the use of the discount voucher with the Vendor
7. Member agrees to indemnify and hold DC and its officers, directors, employees and members for any claims, damages, losses, including reasonable attorneys’ fees arising from or in connection with member’s activities under this Agreement.
8. DC does not endorse or affirm the quality of products or services provided by the Vendor whose discount voucher the member uses.
9. Either party may terminate this Agreement upon giving five (5) days prior written notice to the other party.
10. DC reserves the right to revoke this membership if Member fails to keep and obey any of such rules and regulations, or for reasons of nuisance, disturbance, moral turpitude or fraud against DC, other members of DC or Vendors associated with DC.
11. In the event that DC revokes the membership of a member in terms of clause 11, DC has the right to retain the subscription fees paid by the member.
12. DC hold the right to sue the member for damages for any damage caused by the actions of the member to its good will and name.
13. In the event of a breach of the terms and conditions of this agreement by the member, the member consents that the Magistrates Court of Harare shall have jurisdiction to handle the matter. The member shall be liable to pay both collection commission and legal costs on a legal practitioner and client scale, interest as well as any other costs incurred by DC.
14. The addresses of the parties to this Agreement for purposes of correspondence and for the service of any notice or legal process shall be as set out on the face of this Agreement, which addresses the parties hereby respectively choose as their domicilium citandi et executandi.
15. No waiver by DC on any occasion of any rights conferred upon the Vendor or obligation imposed upon the Vendor by this agreement shall debar DC from exercising such rights or requiring adherence to such obligations on any subsequent occasion, nor shall any indulgence, latitude or grace granted by DC to the Vendor be construed as a waiver of DC’s rights under the agreement.
16. The parties hereto acknowledge that this Agreement constitutes the entire contract between them and that no terms, conditions, stipulations, warranties or representations whatsoever have been made, expressly or by implication, be either party or his agent other than those specifically incorporated herein and that no variations of this Agreement shall be of any force or effect unless reduced to writing and signed for by both parties
